INTRODUCTORY PROVISIONS

These terms and conditions (hereinafter referred to as "terms and conditions") of the business company Advancement Services s.r.o., with registered office at Nádražní 535/15, 702 00. Ostrava, identification number: 25932667, registered in the commercial register maintained by the Regional Court in Ostrava, section C, insert 56142 ( hereinafter referred to as the "accommodator") regulate, in accordance with § 1751 paragraph 1 of Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter referred to as the "Civil Code"), the mutual rights and obligations of the contracting parties arising in connection with or on the basis of an order (hereinafter referred to as the "order") concluded between the seller and another natural person (hereinafter referred to as the "customer") via the accommodation provider's online store. The online store is operated by the seller on a website located at the internet address www.luxurycare.cz/seaside (hereinafter referred to as the "website"), through the website interface (hereinafter referred to as the "store web interface").

The terms and conditions do not apply to cases where the person who intends to purchase goods from the accommodation provider is a legal entity or a person who, when ordering goods, acts as part of his business activity or as part of his independent profession.

Provisions deviating from the terms and conditions can be negotiated in the order. Deviating provisions in the order take precedence over the provisions of the terms and conditions.

The terms and conditions are an integral part of the order.

The wording of the terms and conditions may be changed or supplemented by the accommodation provider. This provision does not affect the rights and obligations arising during the period of validity of the previous version of the terms and conditions.

CLOSURE OF ORDER

All presentation of the accommodation placed in the web interface of the shop is of an informative nature and the accommodation provider is not obliged to enter into a purchase contract regarding this accommodation. The provisions of Section 1732, paragraph 2 of the Civil Code shall not apply.

The store's web interface contains information about accommodation, including listing the prices of individual accommodation. Accommodation prices are adjusted to the customer's person on the basis of the decision on the date of arrival and departure and depending on the choice of accommodation type. This provision does not limit the accommodation provider's ability to conclude a purchase contract under individually agreed conditions.

To order accommodation, the customer fills out the order form in the store's web interface. The order form mainly contains information about:

type of accommodation - specific room / apartment

date of departure and arrival and accommodation

data on the number of persons and data of the ordering person

Before sending the order to the accommodation provider, the customer is allowed to check and change the input data that the customer entered in the order, also taking into account the customer's ability to detect and correct errors that occurred when entering data into the order. The customer sends the order to the accommodation provider by clicking the "BOOK" button. The data listed in the order they are deemed correct by the seller. Immediately after receiving the order, the accommodation provider will confirm this receipt to the customer by e-mail, to the customer's e-mail address specified in the user account or in the order (hereinafter referred to as the "customer's e-mail address").

The contractual relationship between the seller and the buyer is established by the delivery of the acceptance of the order (acceptance), which is sent by the seller to the customer by e-mail, to the e-mail address of the customer.

The customer agrees to use remote means of communication when placing the order. Costs incurred by the customer when using remote means of communication in connection with the conclusion of the order (costs of internet connection, costs of telephone calls) are paid by the customer himself, and these costs do not differ from the basic rate.

PAYMENT, PRICE AND TERMS OF PAYMENT

The customer may pay the price of the goods and any costs associated with the delivery of the goods as ordered to the accommodation provider by cashless payment through the Comgate payment system (https://www.comgate.cz/cz/plat...), choosing from the following payment methods:
1. Payment by card - the most common payment method, we accept Visa, Visa Electron, Mastercard, Maestro. Entering your payment details at the end of the booking process will result in payment and confirmation of your booking.
2. Apple Pay - payment using a card virtualized in the Apple Wallet. The service is displayed to users of Apple devices with Safari browser. Confirming payment via Apple Pay will result in payment and confirmation of the booking.
3. Google Pay - payment with a card stored in Google Wallet. It is displayed on compatible devices. Confirming payment via Google Pay will result in payment and confirmation of the booking.
4. Bank transfers - transfers between bank accounts without the need to use a credit card. The payment gateway allows PSD2 payments, online bank transfers, QR payments and bank transfers without immediate confirmation.

In case of cashless payment, the purchase price is payable immediately at the time of order.

In the case of non-cash payment, the customer is obliged to pay

WITHDRAWAL FROM ORDER
In accordance with the provisions of the Civil Code, the customer has the right to withdraw from the order within fourteen (14) days from the date of the order.
Withdrawal from the order must be sent to the accommodation provider within 14 days of the order. The customer can send the withdrawal to the e-mail address of the accommodation provider info@residencebuffalo.cz.
In case of withdrawal from the order, the order is canceled from the beginning.
In the case of withdrawal from the order according to Article 4.1 of the terms and conditions, the accommodation provider will return the funds received from the customer within fourteen (14) days of withdrawal from the contract by the buyer, in the same way as the accommodation provider received them from the customer.

CANCELLATION POLICY
Cancellation of the stay by the customer - the reservation can be canceled up to 6:00 p.m. 31 days before arrival without a cancellation fee. In case of cancellation between 30 and 16 days before arrival, a cancellation fee of 50% of the reservation amount is charged. In case of cancellation between 15 and 8 days before arrival, a cancellation fee of 70% is charged. In case of later cancellation or change, a cancellation fee of 100% of the reservation amount will be charged. Cancellation of stay requires a written electronic form to the address info@seaside.cz. The date and time of sending the email is decisive for determining the time of cancellation of the stay. If this is not done, the accommodation provider reserves the right to cancel the conditions. For larger groups, individual cancellation fees can be negotiated.
The accommodation provider will not charge the customer the aforementioned cancellation fees if he could not use the agreed services for the following reasons: death in the family, hospitalization of the customer or a member of his family, serious illness, recall order, natural disaster. The customer is obliged to document the above facts with a written document to the accommodation provider within 3 days of their occurrence at the latest.

OTHER RIGHTS AND OBLIGATIONS OF THE CONTRACTING PARTIES
In relation to the customer, the host is not bound by any codes of conduct within the meaning of § 1820 paragraph 1 letter n) of the Civil Code.
The accommodation provider handles consumer complaints via e-mail. Complaints can be sent to the email address of the accommodation provider. The accommodation provider will send information about handling the customer's complaint to the customer's email address. Other rules for dealing with complaints are not set by the seller.
The Czech Trade Inspection is responsible for the out-of-court resolution of consumer disputes arising from the order, with registered office at Štěpánská 567/15, 120 00 Prague 2, ID number: 000 20 869, internet address: http://ec.europa.eu/consumers/... is can be used to resolve disputes between the seller and the buyer from the order.
The European Consumer Center Czech Republic, with registered office at Štěpánská 567/15, 120 00 Prague 2, internet address: http://www.evropskyspotrebitel... is a contact point according to Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on online consumer dispute resolution and amending Regulation (EC) No. 2006/2004 and Directive 2009/22/EC (Regulation on online consumer dispute resolution).
The customer can file a complaint with a supervisory or state supervisory authority. The host is authorized to sell goods on the basis of a trade license. The trade inspection is carried out by the relevant trade office within its jurisdiction. The Office for Personal Data Protection supervises the area of personal data protection. To a limited extent, the Czech Trade Inspection supervises, among other things, compliance with the Civil Code and Act No. 634/1992 Coll., on consumer protection, as amended.

PROTECTION OF PERSONAL DATA
Your information obligation towards the customer in the sense of Article 13 of Regulation 2016/679 of the European Parliament and of the Council on the protection of natural persons in connection with the processing of personal data and on the free movement of such data and on the repeal of Directive 95/46/EC (General Data Protection Regulation) ( hereinafter referred to as the "GDPR regulation") related to the processing of the customer's personal data for the purpose of fulfilling the order, for the purpose of negotiating the order and for the purpose of fulfilling the public law obligations of the accommodation provider shall be fulfilled by the accommodation provider by means of a special document.

SENDING COMMERCIAL MESSAGES AND STORING COOKIES
The customer agrees, in accordance with the provisions of § 7 paragraph 2 of Act No. 480/2004 Coll., on certain services of the information society and on the amendment of certain laws (Act on certain services of the information society), as amended, to the sending of business communications by the seller to an electronic address or to the customer's phone number. The accommodation provider fulfills its information obligation towards the customer in accordance with Article 13 of the GDPR regulation related to the processing of the customer's personal data for the purpose of sending commercial messages by means of a special document.
The accommodation provider fulfills its legal obligations related to the possible storage of cookies on the customer's device by means of a special document.

RECORD OF COMPLAINTS
(a) The receipt of complaints and their separate recording shall be carried out by the employee who maintains the file. The procedure for recording incoming mail must be followed for each complaint lodged.

(b) The register of all complaints lodged must contain, in particular, the following basic information: - the name, surname and address of the complainant, - the date on which the complaint was lodged, - the subject of the complaint, - when and to whom the complaint was forwarded for handling, - the outcome of the investigation of the complaint.

HANDLING OF COMPLAINTS

1. General provisions

(a) All complaints and the facts stated therein must be investigated and dealt with responsibly, economically and without undue delay. The Director shall be responsible for the handling of the complaint.

(b) If the complainant requests that his or her name not be mentioned, the complaint shall be investigated without mentioning the complainant's name.

(c) If he deems it appropriate, he shall hear the complainant, the persons against whom the complaint is made and, where appropriate, such other persons as may contribute to the clarification of the matter. Oral hearings and local investigations carried out in the course of complaints shall be documented by a record containing the names of the participants, a list of the findings and a brief description of the conduct and outcome of the hearing, and the signatures of the participants. If a participant refuses to sign the minutes, this shall be stated in the minutes, with an explanation of the reason. If the oral hearing or local investigation results in a complaint being resolved and the complainant agrees, a separate clause may be included in the minutes stating that the complainant agrees to this resolution and does not request a written response. The receipt of the record by the complainant must be acknowledged.

(d) A complaint criticising the performance of a particular staff member shall be investigated by the staff member's line manager in the presence of the Director. The complaint shall not be assigned to the staff member to whom the criticism relates.

(e) Where a complainant makes a complaint on the same matter repeatedly, it shall be examined whether the original complaint has been properly investigated and dealt with. The outcome of the review must be reported to the complainant. If the complainant, even after the review, makes the same complaint again and does not provide any new facts that would affect the outcome of the investigation, it does not need to be investigated.

(f) A complaint shall be deemed to have been resolved when, following investigation, appropriate remedial action has been taken or a written communication has been sent to the complainant informing him or her, with appropriate reasons, why his or her complaint has not been upheld. The complainant shall always be informed in writing of the manner in which the complaint has been dealt with to the extent necessary. The written notification - the result of the investigation of the complaint - shall be recorded in accordance with point 2(b) of these Rules.

COMPLAINTS UNDER THE FREEDOM OF INFORMATION ACT

a) Complaints about the procedure for handling requests for information under the Freedom of Information Act shall also be accepted as complaints under these Rules. They shall be dealt with in accordance with the FOI Act.

(b) If the obliged body does not fully comply with a complaint under point (a), it shall submit it together with the file within 7 days from the date of receipt to the superior authority which shall decide on the complaint.

TIME LIMITS
Complaints must be investigated and dealt with, including a written reply (by post, electronically) to the complainant, without delay, and no later than 60 days from the date on which they were received. The time limit may be exceeded only if the documents necessary to deal with the complaint cannot be secured within the time limit, and the complainant must always be informed of any extension of the time limit.

ADDRESSING

The customer may be served at the customer's electronic address.

FINAL PROVISIONS

If the relationship established by the Purchase Agreement contains an international (foreign) element, the parties agree that the relationship is governed by Czech law. By choosing the law according to the preceding sentence, the customer, who is a consumer, is not deprived of the protection afforded by the provisions of the legal order which cannot be derogated from contractually and which would otherwise apply in the absence of a choice of law according to the provisions of Article 6(1) of Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I).
If a provision of the terms and conditions is or becomes invalid or ineffective, the invalid provision shall be replaced by a provision whose meaning is as close as possible to the invalid provision. The invalidity or ineffectiveness of one provision shall not affect the validity of the other provisions.
The order, including the terms and conditions, shall be archived by the Seller in electronic form and shall not be accessible.
